No interim injunction against Bollywood movie “Department”: DHC

Delhi High Court refused to grant interim injunction against the defendants, makers of the movie Bollywood movie ‘Department’, for using the catch words of the song ‘Thodi Si Jo Pee Li Hai’ from earlier film ‘Manak Halal’ in their movie.
Applying the principle of harmonious construction in interpreting the license agreement granted by one of the defendants (original maker of movie ‘Namak Halal’) to another, the Court said that the license assigns the rights absolutely and not for a particular term.
Appellant (Shemaroo Entertainment Ltd) filed for an interim injunction against the defendants on the ground that one of the defendant’s cant assign the rights to the work to other defendants after a particular period.
