Delhi High Court quashed the order of the Central Information Commission (CIC) directing the production of the document/correspondences exchanged between the former President and Prime Minister of India respectively relating to Gujarat Riots (2002) to respondent under the Right to Information Act, 2005.
The Court said “…..CIC cannot direct the petitioner (Union of India) to produce the correspondence between the President and the Prime Minister, and since the CIC is not entitled to peruse the correspondence between the President and the Prime Minister, as it is be barred under Article 74(2) of the Constitution of India, the application of the petitioner seeking such an information will also be not maintainable.”
Gujarat riots took place between February-March, 2002 and K.R. Narayanan was the President and A.B. Vajpayee was the Prime Minister.
